1. PRIVACY POLICY
Copas IT Consulting, LLC respects the privacy of their First Cup Site Creator users. We do not disclose or sell user account information to third parties. Your email will be used only to notify you about First Cup Site Creator-related news.
Copas IT Consulting, LLC will not monitor, edit, or disclose the contents of a user's website unless obliged to do so by law or if such action is necessary to: (i) protect and defend the rights or property of Copas IT Consulting, LLC or (ii) fix or debug problems with the First Cup Site Creator software/service.
We do not allow or publish pornographic material, or web sites that engage in phishing, fraudulent purposes, or support criminal intentions. Websites reported to be engaged in such activities will be investigated and due diligence exercised and suspended. This has never happened with any of our clients, but we are publishing this statement here so there will not be any confusion over the matter. Suspension of a website account due to fraudulent or criminal activities is at our sole discretion.
2. DISCLAIMER OF WARRANTIES
As User of the service you agree that the use of the service is at Users sole risk. The service is provided on an "as is" and "as available" basis. Copas IT Consulting, LLC disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Copas IT Consulting, LLC makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or error-free. Nor does it make any warranty as to the accuracy or reliability of any information obtained through this service or that defects in the software will be corrected. You understand that any material/data downloaded or otherwise obtained through this service is done at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results in such a download.
No advice or information, either oral or written, obtained by you from Copas IT Consulting, LLC shall create any warranty not expressly stated herein.
3. LIMITATION OF LIABILITY, INDEMNIFICATION
Copas IT Consulting, LLC shall not be liable for:
(i) Any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service
(ii) Cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through this service
(iii) Unauthorized access to or alteration of Member's transmissions or data, including but not limited to damages or loss of profits
(iv) Statements or conduct of any third party on the service
4. LAWS
The First Cup Site Creator Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia and the United States of America.
5. Non-payment Clauses
First Cup Site Creator is a service provided to our clients. If a client does not remit payment in a timely manner and does not respond to our attempts to contact them via email or telephone, then website services may be suspended for that client. Copas IT LLC and First Cup Site Creator will make an honest effrot to contact the POC for any site that is behind in its payments and is willing to work with clients who may have financial difficulties. However, this service is provided on an at-will basis and falling behind in payments is reasonable cause to suspend services. We will do this only after a reasonable number of attempts have been made to contact a client.
6. Donations, Gifts, and Free Trials
First Cup Site Creator has a 30-day free trial feature. However, site creators (individuals who create sites) under the free trial should recognize that their sites may be deleted or suspended if they do not contract for a permanent site account. From time to time, First Cup Site Creator may temporarily extend the free trial period on request or special arrangement. However, such an extension does not constitute a contract for a permanent service, and such extensions are special cases solely at the discretion of Copas IT LLC and First Cup Site Creator.
7. Exclusions form Service
It is possible that a site owner may host a website that is legally permitted but does not conform to corporate standards of conduct or is incongruent with the business and marketing strategy for Copas IT LLC. In these instances, the site owner will be contacted. The site may be referred to our affiliate service provider and continue without service interruption. However, Copas IT LLC is not obligated to host or support websites that are inappropriate. Copas IT LLC does not support sites that sell Multi-Level Marketing, "Get Rich Quick", or financial schemes. Individuals and organizations that offer real services, products, and information of benefit are welcome to use our services. Unless otherwise specified, we service websites that principally are written in English, we can support French websites and Spanish websites, but we do not actively host non-English character sets at this time. In these instances we are happy to help the site owner locate a professional firm that is fully capable of multi-language site support.
8. Severability, Force de majeure, Remedies
If a portion of this policy is disallowed, the other sections of the policy remain in force.
Copas IT LLC cannot be responsible for Force de Majeure events -- acts of God.
Client Remedies may include the unused portion of site hosting fees that have already been pre-paid and received, minus any administrative charges.
